Court to decide successor to Ind. elections chief

Indianapolis —  

The Indiana Supreme Court will decide whether the Democratic runner-up in the 2010 general election should replace ousted Republican Charlie White as secretary of state.

The court will hear arguments Wednesday over a legal election challenge that seeks to install Vop Osili as the state’s top elections official.

Democrats argue that White’s candidacy was invalid because he was improperly registered to vote and that his conviction on felony voter fraud charges proves their point. They want the justices to uphold a lower court ruling ordering Osili certified as the state’s top elections official.

The Indiana Recount Commission has appealed that ruling. It says state law calls for Republican Gov. Mitch Daniels to appoint White’s replacement and maintains White’s felony conviction has nothing to do with the civil case.
